Requesting GDPR consent to a new or current contact on CRM

- GDPR consent is required by Nouv to allow us to share information on other services offered to a specific client and therefore assisting with the cross selling functions and business development at nouv.

- In an ideal scenario always request consent to a new contact and gather the necessary evidence of consent within the crm.

Please remember:

GDPR mandates that consent be given by data subjects before processing is done for a purpose that is not explicitly agreed upon.
When asking for consent from a data subject, the company must follow the following mandatory requirements:

  1. Consent must be asked explicitly for a clear purpose.
  2. Consent must be freely given. And, consent cannot be linked to provisioning of services that are agreed upon in the contract, or that the data subject is already entitled to.
  3. Consent must not be requested in ambiguous or uncertain language.
  4. Consent must be recorded for future evidence. This means there would be form that is signed or a clear digital action like ticking a check box.
  5. Consent should require a clear and affirmative action on the part of the user. This means pre-ticked check boxes and opt-outs are not acceptable.
  6. Consent should not be bundled; that is, when asking for consent for multiple purposes, the consent for each purpose should be separate. The data subject should have the option to withdraw his or her consent at any point in time.
  7. No processing activity should be carried out prior to receiving written or recorded consent from the data subject.
